Terms of Use

These Terms of Use ("Terms") are a legally binding agreement between you ("you" or "User") and Fuel AI ("Fuel," "we," "us," or "our"), governing your access to and use of the Fuel AI mobile application, the website at fuelit.ai, and all related services (collectively, the "Service").

By creating an account, downloading, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the Service.

These Terms supplement — and do not replace — any agreement you have separately entered into with Apple Inc. regarding the App Store.

You must be at least 13 years of age to use Fuel AI. If you are between 13 and 18 years of age (or the applicable age of majority in your jurisdiction), you may only use the Service with the prior consent of a parent or legal guardian who agrees to these Terms on your behalf.

By using the Service, you represent that you meet the age requirements above, have the legal capacity to enter into this agreement, and that your use does not violate any applicable law.

To access the full features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information at registration and keep it updated;
• Maintain the security of your account password and not share it with any third party;
• Notify us promptly at support@fuelit.ai if you suspect any unauthorised use of your account;
• Accept responsibility for all activity that occurs under your account.

You may not use another user's account without their explicit permission. We reserve the right to disable accounts at our discretion if we believe you have violated these Terms.

Fuel AI is an AI-powered calorie and nutrition tracking application. Core features include:

• AI Meal Scanning — Point your camera at food for instant calorie and macro estimates, powered by AI;
• Calorie Budget Management — Set daily targets and track intake against your personal goals;
• Apple Health Integration — Sync activity data to dynamically adjust your calorie allowance ("Fuel Earned");
• Streak Tracking — Build and maintain daily logging streaks;
• Social Features — Follow friends, view a shared activity feed, react to meals, and share meal cards;
• Progress Analytics — Track weight, macro trends, and goal progress over time.

We may modify, suspend, or discontinue any feature of the Service at any time, with or without notice, and we are not liable for any such changes.

Fuel AI offers a free tier and a premium subscription ("Fuel Premium") that unlocks the full feature set, including unlimited AI meal scans, full social access, and advanced analytics.

All subscriptions are processed by Apple through the App Store. Fuel AI does not directly collect or store your payment information. Pricing is displayed in your local currency within the App Store.

Auto-Renewal

Unless cancelled, your subscription automatically renews at the end of each billing period. Your Apple ID account will be charged within 24 hours before the end of the current period.

Cancellation

You may cancel at any time through Apple ID Account Settings → Subscriptions. Cancellation must occur at least 24 hours before the next billing date. Access to premium features continues until the end of the paid period.

Refunds

Fuel AI does not issue refunds for partial subscription periods. All refund requests must be directed to Apple at reportaproblem.apple.com, as all purchases are processed through the App Store.

We may offer a free trial period for Fuel Premium. If available to you:

• The trial gives full Premium access for its duration;
• Only one free trial is permitted per Apple ID;
• At the end of the trial, you will be automatically charged the applicable subscription price unless you cancel at least 24 hours before the trial ends;
• We reserve the right to modify or end free trial offers at any time.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right;
• Upload or transmit content that is unlawful, harmful, defamatory, obscene, or offensive;
• Harass, abuse, threaten, or intimidate other users;
• Impersonate any person or entity;
• Distribute spam, malware, or other harmful content;
• Attempt to gain unauthorised access to any part of the Service or its infrastructure;
• Reverse engineer, decompile, or disassemble any part of the Service;
• Use automated tools (bots, scrapers) to access the Service without our prior written consent;
• Collect personally identifiable information from other users without their explicit consent.

We may suspend or terminate your account for any suspected violation of these rules.

The Service allows you to submit content including food photos, meal names, profile information, and reactions ("User Content"). You retain ownership of your User Content.

By submitting User Content, you grant Fuel AI a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your User Content solely in connection with operating and improving the Service.

You represent that your User Content does not infringe any third-party rights and does not violate these Terms or any applicable law. We reserve the right to remove any User Content at our discretion.

Fuel AI uses AI to analyse food photos and estimate nutritional content. While we aim for accuracy, AI-generated estimates are approximations only and may be incorrect due to factors including portion size, preparation method, ingredient variation, and image quality.

You acknowledge that:

• AI-generated nutritional estimates are for informational purposes only and should not be relied upon as precise nutritional facts;
• Fuel AI is not responsible for inaccuracies in AI-generated estimates;
• You should independently verify calorie and nutritional information where precision matters.

The Service is for general wellness and habit-tracking purposes only. All information provided — including calorie targets, macro recommendations, and nutritional estimates — is informational and motivational in nature.

You should consult a qualified healthcare professional, registered dietitian, or nutritionist before making significant changes to your diet or exercise routine, especially if you have a pre-existing medical condition. Fuel AI is not appropriate as the sole tool for managing eating disorders, clinically prescribed dietary plans, or any medical condition. You use the Service at your own risk.

Fuel AI integrates with Apple HealthKit to read activity and workout data for the purpose of calculating your "Fuel Earned" calorie adjustment. By enabling this integration:

• You grant Fuel AI read access to the specific HealthKit data types you approve in iOS;
• You may revoke access at any time via iOS Settings → Privacy & Security → Health → Fuel;
• HealthKit data will not be used for advertising or shared with third parties, in accordance with Apple's HealthKit guidelines.

App Store Notice

Apple is not a party to these Terms and is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for Fuel AI.

All content, features, and functionality of the Service — including the Fuel AI name, kiwi logo, interface design, and software — are owned by Fuel AI or its licensors and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes. You may not copy, modify, sell, sublicense, or create derivative works from any part of the Service.

Our total liability to you for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or USD $100 if no payment has been made.

You agree to defend, indemnify, and hold harmless Fuel AI and its officers, directors, employees, and agents from any claims, liabilities, damages, or costs (including reasonable legal fees) arising from your violation of these Terms, your User Content, or your use of the Service in violation of applicable law.

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms. You may delete your account at any time from the Profile screen in the app.

Provisions of these Terms that by their nature should survive termination will continue to apply after termination.

These Terms are governed by applicable laws. Any disputes shall first be attempted to be resolved by good-faith negotiation within 30 days. If unresolved, disputes shall be submitted to binding arbitration. You waive the right to participate in class action lawsuits to the extent permitted by law.

EU/UK consumers retain the right to submit complaints to their local consumer protection authority or use the EU Online Dispute Resolution platform.

We may update these Terms at any time. For material changes, we will update the effective date and notify you via in-app notification or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
